Terms Of Service

Your participation in Sony Music Canadaís Communities, including, without limitation, all chat rooms and discussion threads (bulletin boards), is subject to the following terms, conditions and guidelines. Use of Sony Music Canadaís Communities by you indicates your acceptance of such terms, conditions and guidelines.

Sony Music Canadaís chat rooms and message boards are free community spaces designed to provide you and other members with a flexible forum for communicating and expressing ideas.

You are solely responsible for your postings, messages and online behavior. Respect fellow Community members.

You acknowledge that, by providing you with the ability to publish and distribute your postings and messages, Sony Music Canada is acting as a passive conduit for such publication and distribution. You may not post on a Sony Music Canada Community or transmit through a Sony Music Canada Community any material which violates or infringes in anyway upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent or otherwise objectionable, which encourages conduct that would constitute a criminal offense, gives rise to civil liability or otherwise violates any law. No conduct shall be undertaken that, in judgment of Sony Music Canada, restricts or inhibits any other user from using or enjoying Sony Music Canada Communities.

Sony Music Canada is not obligated to screen or edit messages or other materials before they appear in a Sony Music Canada Community, nor is Sony Music Canada obligated to monitor usage or supervise the chat rooms or private conversations. Therefore, parents, you may want to supervise your children's use of Sony Music Canada Communities.

While Sony Music Canada Communities do not support censorship, you understand that Sony Music Canada has the right, but not the obligation, to monitor the content of Sony Music Canada Communities to determine compliance with this Agreement and any other operating rules established by Sony Music Canada. Sony Music Canada shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on a Sony Music Canada Community. Without limiting the foregoing, Sony Music Canada shall have the right to remove any material that Sony Music Canada, in its sole discretion, finds to be in violation of the provisions hereof, otherwise objectionable or stale.

Notwithstanding this right of Sony Music Canada, you shall remain solely responsible for the content of your messages. Sony Music Canada reserves the right to take any actions that it believes prudent or necessary to minimize or eliminate potential liability, including, without limitation, canceling memberships. You acknowledge and agree that neither Sony Music Canada nor any third party content provider shall assume or have any liability for any action or inaction by Sony Music Canada or any third party content provider with respect to any conduct, communication, posting or message on or through Sony Music Canada Communities.

No material protected by copyright, trademark or other proprietary right shall be uploaded, posted or otherwise made available on Sony Music Canada Communities without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with you. You shall be solely liable for any damages resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from any uploading, posting or submission.

Please note that offenders will be permanently banned from Sony Music Canada Communities in order to protect our users. Examples of offenses performed by users which may result in termination of Community memberships include, without limitation, the following:

1.Use of an offensive handle, or signing into multiple forums.

2.Harassing other users or impersonating them.

3.Discussing topics of an obscene or harassing nature.

4.Advertising or soliciting of any kind.

5.Posting or sending adult materials.

6.Repeated abuse of text, including repeatedly sending extra long text messages or any malicious hacking that makes it difficult for people to read the screen.

7.Any other activity that Sony Music Canada, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

You hereby grant to Sony Music Canada a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any message posted in Sony Music Canada Communities (in whole or in part) and/or to incorporate it in other works in any form, media or technology now known or later developed.

You understand that chat rooms, message boards, and all material contained in Sony Music Canada Communities are provided on an "AS IS" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
