1. Ways to Enter the Contest.
No purchase is necessary to enter. To enter email your full name and phone number with area code to thenewcities@gmail.com with the subject line “The New Cities Tickets” after 10:00am EST on Monday, April 13, 2009 but no later than 11:59pm EST on Friday, April 17, 2009 (the “Contest Closing Time”). Limit of one entry per person. All entries that are incomplete, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified.
2. Eligibility
The Contest is open to all legal residents of Canada who are 13 years of age or older at the time of entry. Entrants under the age of majority are eligible to win provided their parent or legal guardian accepts the Prize on his/her behalf. Employees, officers, and directors (including immediate family members and members of the same household) of Sony Music Entertainment Canada Inc. (the “Sponsor”) and their respective distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.
3. Prize
One Prize (the “Prize”) is to be awarded consisting of admission for two (2) to an upcoming The New Cities concert, in the city nearest to the winner’s place of residence and which the winner is entitled to attend (Approx. retail value per prize $30.00CDN). Entry to certain concerts of The New Cities is restricted to persons over a certain age. As such, if the winner is under the minimum entry age for the concert in the city nearest to the winner’s place of residence, the Prize will consist of admission for two (2) to The New Cities concert nearest to the winner’s place of residence where the winner is over the minimum entry age (if any). Transportation is not included. The Prize winner is solely responsible for all costs not expressly described herein. The Sponsor reserves the right to substitute the Prize in whole or in part for a prize of equal or greater value in the event that any component of the Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.
4. The Draw
The winner of the Contest will be selected in a random drawing conducted by the Sponsor of all eligible entries received by the Contest Closing Time. The odds of winning depend on the number of eligible entries received. The random drawing will take place at approximately 11:00 a.m. EST on Saturday April 18, 2009 at the Sponsor’s offices at 150 Ferrand Drive, Ste 300, Toronto, ON. The Sponsor will attempt to notify the selected entrant by telephone within 24 hours of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 24 hours, complete and return to the Sponsor a contest eligibility and liability/publicity release confirming compliance with these rules and regulations, releasing the Sponsor, its affiliates, and their respective directors, officers and agents (the “Released Parties”) from all liability and, except where prohibited by law, permitting the Sponsor to use the selected entrant’s name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet,in any publicity carried out by the Sponsor. If the selected entrant is under the age of majority, the contest eligibility and liability/publicity release must be submitted by the selected entrant’s parent or legal guardian. The guest of the selected entrant (or, if such individual is under the age of majority, his or her parent or legal guardian will also be required to submit a liability/publicity release releasing the Released Parties from all liability and, except where prohibited by law, permitting the Sponsor to use the guest’s name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor. Selected entrants may be required to provide proof of identity (photocopy of Driver’s License, Passport or any other government-issued photo identification). In the event that a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after one business day of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant(s).
5. General
By entering the Contest, entrants agree to abide by these rules and regulations, and further agree that the decision of the Sponsor is final. The Sponsor reserves the right at any time without prior notice to withdraw, cancel, terminate, amend, modify or suspend the Contest if for any reason in the opinion of the Sponsor, in their sole discretion and, subject to the prior approval of the Régie des alcools, des courses et des jeux for residents of Quebec only, the Contest is not capable of operating as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond their control. The Sponsor reserves the right in their sole discretion and, subject to the prior approval of the Régie des alcools, des courses et des jeux for residents of Quebec only, to disqualify any individual they find to be tampering with the operation of the Contest or to be acting in violation of these rules or otherwise in disruptive manner with respect to the Contest. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. The Sponsor also reserves the right to cancel this contest at any time because of any printing or other error. The Sponsor does not assume any responsibility for technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software (including on account of traffic congestion on the Internet or at any Web site) or any combination thereof. The Sponsor shall not be liable for any errors or negligence that may arise or occur in connection with the Contest, including any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation in or downloading of any materials relating to the Contest. The Sponsor is not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prize. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
6. Privacy and Personal Information
The Sponsor will be collecting data about entrants through the Contest entry process. Any personal information will be handled in accordance with the privacy policy of the Sponsor which can be found at http://www.sonymusic.ca/privacy/en/. By entering the Contest each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest.The Sponsor will not sell or transmit this information to third parties unless the entrant has specifically consented to same, the Sponsor believes in good faith that it is required by law, to their affiliates (provided that such affiliates and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these rules and regulations), or to their respective agents for data processing purposes, their respective professional advisors and promotional and marketing agencies (provided that such agents, professional advisors and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these rules and regulations). 7. Publicity of Winner’s Name
The name of the Prize winner will be posted on the website located at: www.thenewcities.com on or about April 21, 2009.
8. Subject to Applicable Laws
This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Quebec residents only, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. For Quebec residents only, any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
